The Chairman further advised that, as one of the complainants in the matter under consideration, Councillor Mrs. A. E. Doyle would not be participating in the proceedings.

Exclusion of the Public

[To consider, and if considered appropriate, to pass the following resolution to exclude the public from the meeting during the consideration of an item of business containing exempt information:

 

"RESOLVED: that under Section 100 I of the Local Government Act 1972, as amended, the public be excluded from the meeting during the consideration of the following item of business on the grounds that it involves the likely disclosure of exempt information as defined in Part I of Schedule 12A to the Act, as amended, the relevant paragraph of that part being as set out below, and that it is in the public interest to do so:

Minutes:

The Committee considered whether or not to exclude the public from the meeting for consideration of Agenda Item No. 4; Investigating Officer’s Final Report – Complaint References: 03/09 and 04/09.  In doing so, the Committee considered whether the public interest in maintaining the exemption outweighed the public interest in disclosing the information, which the Committee agreed it did not.

 

RESOLVED that the public not be excluded from the meeting for Agenda Item No. 4 and that the report therefore be placed in the public domain.

Further to a referral from the Standards Assessment Sub-Committee in July 2009, the Committee was asked to give consideration, under Regulation 17 of the Standards Committee (England) Regulations 2008, to the Final Report of the Investigating Officer in relation to two allegations that Councillor P. McDonald had breached the Bromsgrove District Council Code of Conduct by disclosing confidential information.  The Investigating Officer had made a finding that Councillor McDonald had not failed to follow the Code of Conduct of Bromsgrove District Council.

 

RESOLVED that the Investigating Officer’s finding of no failure (“a finding of acceptance”) in relation to the allegations against Councillor McDonald be accepted.
