The Chairman opened the Hearing and introduced the Members of the Sub-Committee and officers present to the Applicant and the Applicant’s representative.

 

The Chairman welcomed the Applicant and the Applicant’s Representative and invited them to introduce themselves.

 

The Chairman reminded all parties present of the procedure to be followed during the Hearing and that those parties present could be represented by a legal representative at their own expense.

The Sub-Committee was asked to consider an application for a Street Trading Consent in respect of Anthony Charles Woolley to provide hot and cold food and drinks from a mobile unit sited at Slideslow Lay-by, Stratford Road, Bromsgrove.

 

The Licensing Manager outlined the details of the application, together with the reasons why the application had been brought before the Sub-Committee, detailing the Council’s Street Trading Consent Policy.  The Licensing Manager advised that a document detailing approximately 640 signatures in support of the application had been received.  The Sub-Committee consented to the introduction by the Applicant of the document, a copy of which was circulated for all parties present to read.

 

At the invitation of the Chairman, the Applicant’s representative put forward the case for the Applicant.  She explained that it was a family run business which had traded from the site for 15 years and that the letters of support and the petitions supporting the application had showed loyalty from their customers and she felt that the business provided for the needs of the area.  The Applicant answered a number of questions from Members of the Sub-Committee with regards to the scoring received under the star award scheme operated by the Council’s Environmental Health Team and on waiting restrictions.

 

The Sub-Committee then adjourned to consider its decision.  Upon its return and having had regard to:

 

§         The Council’s criteria for Street Trading Consents as set out in the Street Trading Consent Policy

§         The application and representation made on behalf of the Applicant

§         The relevant representations made in writing by the consultees

 

RESOLVED that the application for a Street Trading Consent for the sale of hot and cold food and drinks from a mobile unit sited at Slideslow Lay-by, Stratford Road, Bromsgrove be granted as follows:

 

Actual Trading Hours

 

§         08:00am – 14:00pm Monday to Friday

§         08:00am – 13:00pm Saturday

§         No trading on Sunday

 

The reasons for the Sub-Committees decision were as follows:

 

§         The application met the criteria in the Street Trading Consent Policy;

§         The Sub-Committee noted that the business had been in operation from the lay-by for 15 years and no formal complaints had been received;

§         The Sub-Committee noted the contents of the written representations received and also noted the letters and petitions in support of the application; and

§         The Sub-Committee considered that the lay-by was subject to a traffic regulation order but noted that in this regard no response to the consultation had been given by either the police or the County Council.

 

The Chairman reported that the Applicant and those parties who made representations would be notified of the decision in writing within 5 working days.
