Minutes:
The Head of Planning and Regeneration Services reported the receipt of an indicative lighting scheme for the proposal and comments from the Highways Engineer and the District Council’s Environmental Health Officer.
The Committee was reminded that a similar permission had previously been granted for the scheme, which had since expired. Officers advised that they were not aware of any recent changes in legislation that would have any significance for the new application.
Members’ concerns in regard to lighting spill were alleviated by Officers who confirmed that the scheme’s lighting levels would be appropriately controlled by condition. Officers further clarified a number of points raised in relation to the diversion of the Public Right of Way that crossed the site and further recommended that, if Members were minded to approve the Application, the proposed Condition 11 be deleted and it be recorded as an Informative only, instead.
At the invitation of the Chairman, Mr A. Richings addressed the Committee and spoke against the application.
RESOLVED that
1) subject to the receipt of no further representations during the remainder of the consultation period and subject to the conditions and notes set out or referred to on pages 30 to 32 of the report but with Condition 11 being deleted and it being recorded as an informative instead, authority be delegated to the Head of Planning and Regeneration Services to approve Planning Permission upon expiry of the consultation period on 1st May 2012: or
2) in the event of further representations being received before the expiry of the consultation period, authority to determine the application be delegated to the Head of Planning and Regeneration Services, in consultation with the Chairman of the Planning Committee, to assess whether new material considerations have been raised, and to issue a decision after the expiry of the statutory publicity period accordingly.
